
MLex Summary: ROSS Intelligence asked a US federal judge to allow it to immediately appeal a summary judgment in favor of Thomson Reuters on direct copyright infringement of certain Westlaw headnotes and against ROSS Intelligence’s affirmative defenses. ROSS said that there are substantial grounds for difference of opinion on whether the headnotes fail the Copyright Act’s originality requirement and whether ROSS’s use of .076 percent of Westlaw’s headnotes to help train an AI search engine is transformative or otherwise a fair use.
